At Viva Active, we respect your privacy and are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
This policy is issued by Viva Group Holdings Pty Ltd trading as Viva Active, Suite 3, 132-134 Burwood Road, Burwood NSW 2134.
INFORMATION WE COLLECT
From our website, when you enquire or browse:
- Name, phone number and email address
- Information you provide through enquiry or contact forms
- Information about how you use our website, including cookies, IP address, browser type and pages visited
From the Viva Active app, when you train with us:
- Account details: your name, email, mobile number, date of birth and emergency contact
- Health and fitness information: bookings and attendance, the goals and targets set with your trainer (steps, calories, macros, weight), weigh-ins, progress photos you upload, food and workout logs, and daily goal check-ins
- Location: while the app is open, your position for the companion map, step counting and event check-ins. We do not track your location in the background
- Messages you send to your trainers, and notices you post to the community
- Device information needed to send the notifications you have turned on
- Apple Health data (steps, walking distance, active energy, heart rate and weight) only if you choose to connect Apple Health in the app. This is read only, is never used for advertising, and is never shared with third parties
HOW WE USE YOUR INFORMATION
We collect your information to:
- Respond to enquiries and book consultations or appointments
- Provide personal training, group classes and nutrition coaching, including building and adjusting your training and nutrition plans
- Run your membership, bookings and attendance
- Run the in-app companion, XP and rewards, and community features such as leaderboards (first name and initial only, and you can opt out)
- Send the reminders and messages you have chosen in the app's settings
- Improve our website, app and customer experience
- Send marketing communications where you have chosen to receive them
- Keep our services working and secure, and comply with legal obligations
HEALTH INFORMATION
Fitness, nutrition and body-composition information is sensitive information under the Privacy Act. We collect it only with your consent, which you give by accepting this policy and by entering that information, and we use it only to coach you. Training plans, nutrition estimates and XP shown in the app are generated automatically from what you enter. They are general guidance, not medical advice. Please raise any pain, injury or health condition with your trainer or a medical professional before starting, and stop if anything hurts.
SHARING YOUR INFORMATION
We do not sell or rent your personal information, and we do not share it with advertisers.
Your information is visible to your Viva Active trainers and studio staff. Other members see only what you choose to share: leaderboard entries (first name and initial), plans you share to the community, and notices you post with the people who join them.
We may share your information with trusted service providers who help us operate our business, including website hosting, app hosting and database services, analytics, customer management systems, SMS delivery and payment providers. They process information on our behalf and may not use it for their own purposes. We may also disclose information if required by law.
OVERSEAS DISCLOSURE
Some of our service providers store or process information outside Australia, including in the United States and the European Union. We take reasonable steps to ensure they handle your information consistently with the Australian Privacy Principles.
CHILDREN
Our services are intended for people aged 16 and over. We only collect information about a person under 18 with the consent of a parent or guardian, arranged through the studio.
COOKIES
Our website may use cookies and similar technologies to improve your browsing experience and understand how visitors use our website. You can disable cookies through your browser settings, although some parts of the website may not function correctly. The app does not use advertising cookies or third-party tracking.
DATA SECURITY AND RETENTION
We take reasonable steps to protect your personal information from misuse, interference, loss and unauthorised access, including authentication, access rules that limit each member's data to that member and their trainers, and encryption in transit. While we use appropriate security measures, no internet transmission can be guaranteed to be completely secure.
We keep your information while you are a member and for up to 7 years afterwards where required by law or for our records, then delete or de-identify it. You can ask us to delete it sooner.
If a data breach occurs that is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner in line with the Notifiable Data Breaches scheme.
YOUR CHOICES AND RIGHTS
- Access and correct your details at any time in the app under Settings, or by contacting us
- Turn notifications on or off by type, and set quiet hours, in the app's settings
- Turn location off at any time in your device settings. Step counting and the companion map will stop working
- Hide yourself from community leaderboards in the app's settings
- Request a copy of the personal information we hold about you by contacting us
- Delete your account and your data from within the app, or by contacting us
COMPLAINTS
If you have a concern about how we have handled your information, please contact us first using the details below and we will respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
CHANGES TO THIS POLICY
We may update this policy from time to time. If a change materially affects how we handle your information, we will ask you to accept the updated policy in the app.
